This is privacy policy of Moonla App ("Moonla", "us", "we", "Service" or "our"). We provides this App at no cost and is intended for use as is. The app contains paid services, which are subject to the page display.

Moonla App respects your privacy. Accordingly, we have developed this Policy. PLEASE READ THIS POLICY CAREFULLY to understand how we collect, use, communicate, disclose, and use personal information. Your access to, download, installation, use of, registration for a Moonla account, or login to this service all constitute your acceptance of and agreement to all the terms of this Policy. By these actions, you agree to our collection and use of information in relation to this Policy.

The personal information we collect is used to provide and improve our emotional companionship and journaling services. We rely on the TERMS AND CONDITIONS we enter into with you, your consent, and the legal bases regulated by law to process your personal data. We will process your personal information by lawful and fair means and protect your personal information with reasonable security safeguards against loss or theft and unauthorized access, disclosure, copying, use, or modification.

The terms used in this Privacy Policy have the same meanings as in our TERMS AND CONDITIONS, which are accessible at Moonla unless otherwise defined in this Privacy Policy.

1. What Data We Collect

Moonla App may collect certain data which will not be beyond what is reasonable to provide our product or service during your visit or using Moonla App. This section describes the different types of personal information we collect from you and how we collect it.

  • (a) Image collection. In order to implement the function of uploading profile pictures and sending pictures in private messages.
  • (b) Account registration information. When you apply to register as a Moonla user, you need to log in with a Google account or Apple account, and we will obtain your email address from Google or Apple. At the same time, you may need to provide a nickname, birthday, gender. It should be noted that your nickname will be publicly displayed in the app.
  • (c) Payment Information. When you want to use the paid service, you need to recharge to redeem credits, we will collect your order number and order amount.
  • (d) Device information and service log information. In order to provide you with services, during your use of Moonla, we will collect your device brand, device model, device screen resolution, operating system version, operating system language, device MAC address, device serial number, unique device identification code (on Android, this may include IMSI, IMEI, Android ID; on iOS, this may include IDFA, if available), network type, IP address, service log information, etc.

It should be noted that device information, service log information, etc. alone cannot identify a specific natural person, and will not be regarded as personal information unless such information is combined with other personally identifiable information.

  • (e) Clipboard Data. When you share or receive data, we need to access your clipboard to read the password, code and link to achieve function including jumping, sharing, and activity linkage.
  • (f) User-Generated Content for Journaling. Data you voluntarily input into the App for self-reflection and emotional tracking purposes, such as your mood logs, journal entries, and personal affirmations. This data is used solely to provide personalized emotional support and is not used for medical diagnosis.

In the process of using our products or services, you shall not provide us or others with the personal information of any third party without the authorization and consent of the third party. If the content you provide contains the personal information of a third party, it is deemed that you have obtained the explicit consent of the third party (or if the personal information of minors is involved, you are deemed to have obtained the express consent of their guardians) and allow us to process the relevant personal information in accordance with this Privacy Policy. You are solely responsible for all liability arising from such actions and shall bear all adverse consequences.

You understand and agree that the products or services we provide to you are constantly updated and evolving. If a product or service is not listed in the aforementioned description and it is really necessary to collect your information, we will obtain your consent separately through page prompts, system notices, website announcements, etc.

2. How We Use Your Personal Information

  • 2.1 We use your personal information for the purpose of performing the contract between you and us or to provide you with our products or services. In different scenarios, depending on your use of services, you need to provide certain personal information, or we actively collect certain personal information about you, or we obtain your personal information from third parties with your consent. Please see Section 1 of this Privacy Policy for details.
  • 2.2 We use your personal information for security reasons. It is used to identify the abnormal status of the account, understand the suitability of the equipment, solve product failures, ensure the security of your account transactions and system operation, prevent and identify fraud and other illegal activities, and ensure the normal operation of the products or services we provide.
  • 2.3 We use your personal information for data statistics or analysis. In order to improve our products or services, we may de-identify or anonymize the collected information for internal audit, data statistics, data analysis and research.

  • 2.7 We request following device permissions to ensure key features of the app function smoothly and securely. We promise that all permissions will only be enabled with your explicit consent, and we will never retrieve or use them without your authorization. Your photos and personal data will be strictly encrypted and stored. We will not share, sell or disclose your private information to any third party. If you refuse to grant permission, it will only affect use of relevant personalized functions and will not interfere with other basic services of the App. We continuously optimize our data security system and adopt industry-leading technological means to ensure your privacy is at ease.     • NSCameraUsageDescription: Moonla needs to access your camera when you provide feedback on issues.

3. How We Share Your Personal Information

Moonla App respects your privacy and will never sell or trade your personally identifiable information to third parties. However, we will share your personal information with third parties in the following cases:

  • 3.1 With your consent or as directed by you.
  • 3.2 Sharing with affiliates. Our products or services may be provided by our affiliates and your personal information may be shared with our affiliates. We will only share personal information that is necessary and is bound by the purposes stated in this Privacy Policy.
  • 3.3 Sharing with authorized partners. For the purposes and use stated in this policy, some of our business will be assisted by authorized partners, and we may share some of your necessary personal information with authorized partners. Our partners are not authorized to use the shared personal information for any other purpose. For example, our payment services providers handle financial transactions relating to Moonla. We will share transaction data with our payment services providers only to the extent necessary for processing payments for services or products as well as refunding such payments.
  • 3.4 For legal reasons. Where required or permitted by law, we may share your information with courts, law enforcement, governmental or public authorities, arbitration institutions, authorized third parties, or as reasonably necessary to disclose your information: (i) to comply with our legal obligations, (ii) to comply with a valid legal request (such as a subpoena or court order) or to respond to a claim against Moonla; (iii) respond to valid legal requests related to criminal investigations to address suspected or suspected illegal activity; (iv) necessary for the performance of our agreement with Users, or (v) to protect rights, property or personal safety of Moonla, its employees, Users, advisors or members of the public.
  • 3.5 Third-Party Services. To provide necessary functionality, we may engage specific third-party service providers. The specific services that may involve data processing include:
    Authentication: Google Sign-In, Sign In with Apple
    Infrastructure & Storage: Tencent Cloud (COS, Chat SDK, Push)
    Payment: Apple In-App Purchase

    Note: Technical utility libraries that do not collect user data (such as UI components, local storage, animation libraries) are not listed.

4. How Long Your Personal Data Will Be Kept and Protected

  • 4.1 We will retain your personal data for no longer than is necessary for the purpose for which such personal data is processed. Please note, however, that we may retain and use your personal data as necessary to comply with our legal obligations, to resolve disputes, and to enforce our agreements and rights, or if it is not technically and reasonably feasible to remove such information from our databases, which means that we may retain and use your personal data as necessary after you stop using our platforms.
  • 4.2 We strive to use various security measures to protect the personal information you provide against unauthorized access, public disclosure, use, modification, damage or loss of data. 5. How We Use Cookies

  • 6.1 Access, modify, correct, supplement, delete your personal information. When you register as a user of Moonla, you have the right to access, modify, correct, supplement or delete some of your personal information through the Moonla app. It is important to note that some information we collect may not be modified or deleted due to the requirements of laws and regulations, the needs of our business operations or security.
  • 6.2 Cancel your account. You have the right to cancel your registered account at any time via the Moonla app. In particular, your decision to voluntarily apply for account cancellation means that you confirm that there are no unresolved disputes with Moonla and the advisors, and irrevocably waive all rights and interests in the user account. Once the user account is cancelled, it cannot be recovered, and you will not be able to retrieve all the content and information in the user account and related to the account.

If you are unable to cancel your account through the above methods, you can contact us through the methods listed in Article 11. Before cancellation, we will verify your personal identity and other information to ensure that it is you who requested the cancellation of the account.

  • 6.3 Respond to your above request. If you are unable to manage your personal information through the Moonla app, you can contact us via email support@moonla.live. For security reasons, we may ask you to verify your identity and respond to your above request.

7. Links to Other Sites

This Service may contain links to other sites. If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by us. Therefore, we strongly advise you to review the Privacy Policy of these websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

8. Minors under Age 18

  • 8.1 Our services offered herein are not intended for persons under the age of 18. Moonla app prohibits children under the age of 18 from using Moonla app and any services provided by the app.
  • 8.2 Moonla app will not knowingly collect personally identifiable information from children under 18. If we discover that a child under 18 has provided us with personal information, we immediately delete this from our servers. If you are under the age of 18 or If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us at support@moonla.live so that we will be able to do the necessary actions.

9. International Data Transfers

  • 9.1 Please note that due to the global nature of our business, we may transfer your personal data outside your country of origin with our group companies, subcontractors and partners in order to provide our service to you. You understand and consent to the transfer.
